Mumbai: After the separation of Eknath Shinde and Uddhav Thackeray faction, the legal battle between the two sides over control of Shiv Sena continues.
The Supreme Court, while hearing the hearing on Thursday, has given relief to the Uddhav faction. The court asked the Election Commission not to take any decision on the Shinde faction’s plea for the time being. The matter will now come up for further hearing on Monday.
Earlier on Wednesday, the matter was heard in the Supreme Court where both the factions had defended themselves. A decision regarding referring the case to a five-judge bench will be taken.
The written arguments of both the parties will be verified. During the hearing, Shinde camp’s counsel Harish Salve put up the points of the proposed hearing on his behalf. Salve kept things up in a systematic manner about the speaker’s authority on the disqualification and the manner in which the process was completed.
The CJI asked if the party does not have control over the MLA once he is elected. He is only accountable to the discipline of the party’s legislature party? In response, Salve, counsel for the Shinde group, said that as long as he is in the post of MLA, he is entitled to participate in the activities of the House. If he votes against the party also, that vote will be valid.
